Acceptance of the General Conditions

Access to this site or its use for whatever means implies the acceptance of these general terms established by Monoware Ltd. The user will be responsible for reading the Terms and Conditions. The use of certain services also imply acceptance, without reservation, of the special rules or instructions Monoware Ltd. could establish on an ad hoc basis, to replace or complement these general conditions. The conditions of use of this website are indefinite. Monoware Ltd. reserves the unilateral right to change the content.

Terms of Website Use

Every effort is made to ensure that this website is free from viruses. However, this cannot be guaranteed. Protecting the confidentiality of your password and any activity on your account is your responsibility. Monoware Ltd. will not be liable for loss or damage which may occur if you don’t protect your password. Our website may contain links to external websites that are not in any way affiliated with Monoware Ltd. Please be aware that Monoware Ltd. does not guarantee the accuracy or completeness of any information on these external websites.

PHOTOGRAPHIC REPRESENTATION

We make all effort to accurately depict our products. However, some slight variation may occur so images should be used only as a guide. The reproduction of colour is as accurate as possible, but different computers display colours differently, so we cannot guarantee the complete accuracy of the pictures or photographs shown. All measurements provided are approximate.

Monoware Ltd. owns the rights to the intellectual property of this website. Monoware Ltd. also owns the intellectual property rights, industrial and image of the content available on this website, and the sole authority to allow its use elsewhere. Access, navigation and use of this website by the user does not imply any waiver, license or right transfer from Monoware Ltd.

It is therefore not allowed to remove, ignore or manipulate the copyright notice (“copyright”) and any other data identifying the rights of Monoware Ltd. or its owners included in the content as well as technical protection devices, digital fingerprints or any mechanisms or identifying information that could be part of the content. We make every effort to ensure that the information on the Monoware website is current and correct. However, we cannot guarantee that the information will be accurate, current or complete at all times and take no responsibility for errors or omissions in the contents on the Service.

Monoware Ltd. shall not be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract or negligence, arising out of or in connection with the use of the Service or the contents of the Service. Monoware Ltd. reserves the right to modify the contents of the Service and terms and Conditions without prior notice. Should this happen the new Terms and Conditions will be effective immediately and automatically supersede prior published information. Monoware Ltd does not warrant that the website is free of viruses or other harmful components.

PRODUCT RECALL
We reserve the right to withdraw any products from our website at any time and / or remove or edit any materials or content. We will not be liable to you or to any third party because product withdrawal from our website monoware.com.

MODIFICATION AND TERMINATION OF SERVICES
Monoware Ltd. has the right to modify, suspend or terminate the provision of services from monoware.com content, in whole or in part, at any time, without prior notice to users of the website.

Terms & Conditions of Sales

Unless otherwise agreed in writing by Monoware Ltd., all goods are supplied on the following conditions to the exclusion of any terms or conditions stipulated by the buyer and of any representations, warranties or communications not expressly incorporated herein or in the order confirmation.

ORDER
By placing an order through monoware.com you warrant that you are of legal age and fully authorised to use the corresponding credit or debit card, if you choose this method of payment. To order, follow the online purchasing process to payment. We will email you an order confirmation after which you will have entered into a purchase contract with us.

You also undertake to provide us with a true and correct e-mail address, mailing address and / or other contact details, so that we can use this information to contact you if necessary in accordance with our Privacy Policy. If you do not provide all the correct information we need, we cannot complete your order successfully. You can identify errors in the data provided in the confirmation emails we send you, and if necessary, correct them via emailing customer service at webshop@monoware.com.

CANCELLATION
The following terms only apply to goods and services bought via our website. For Monoware goods bought from any other outlet please refer your request to the outlet from which you bought it. As stipulated by the Consumer Contracts Regulations, if you buy online or by phone, you may return or exchange goods within 14 working days of delivery.

All amendments to orders or requests for cancellation must be notified in writing either by email at webshop@monoware.com or by post to Monoware Ltd., 155C Lordship Lane, SE22 8HX London. Please state the order number (which you can find in your order confirmation email), your name and address, the date you placed the order and giving your clear instruction to cancel the order. 

RETURNS & EXCHANGES
The product you return must be in their original and unused condition. We are unable to accept any item with any sign that it was used. We strongly advice to package your goods carefully, as we are unable to refund any item which arrives damaged at our warehouse. 

Returned products will be credited to the original payment method, excluding delivery costs, within 7 working days. For security reasons, refunds are made by the same method as the original payment was made.

UK

We offer free returns on all UK orders. To start a return or exchange, please write to webshop@monoware.com with your order details and we will send you a free returns label straight to your inbox. Print and attach the label, include a copy of your packing slip and write RETURN and your order number starting with MONO on the package and post to:

INTERNATIONAL
We're happy to extend the same returns policy to our international customers, although you'll need to cover the cost of return postage. Please notify us and follow instructions outlined above. Postal charges, customs charges and handling fees will be deductible from any refund due. 

International customers take full liability for parcels returned to us due to unpaid customs or tax charges. 

DELIVERY
In order to keep your goods in the best condition possible during transit, they are carefully packaged to avoid damage. It is essential you keep the packaging until you are 100% satisfied with your order. This is in case the delivery company need to inspect the packaging following a report of damage. If you wish to return your order for any reason we can only accept the products if returned in their original packaging.

Delivery dates acknowledged by Monoware Ltd. are non-binding estimates only, based upon the best available information concerning transportation schedules. Therefore, orders may be shipped on, prior to (with the buyers' approval) or after the estimated date (after notification to the buyer).

Special delivery conditions requested by the buyer should be given in writing at the time of the order placement and charges may change accordingly. 

Monoware Ltd. reserves the right to vary the type of shipping and transport company. The shipping costs resulting from purchased items will be reflected in the final moment of purchase and will depend on the destination.

SHIPPING
The delivery of each product may depend on many factors such as origin, the availability of stock, holidays, etc. The delivery time is 1 to 7 working days. This period will be treated as working days (Monday to Friday except holidays) and will apply the following conditions: The delivery time of 1 to 7 working days is an average and therefore an estimate. It may, therefore, vary for logistical reasons or force majeure. If for some reason, we cannot meet the estimated delivery date, we will inform you and give the option to proceed with the purchase by establishing a new delivery date or cancel the order with a full refund of the price paid. Please note, however, that we do not deliver on Saturdays or Sundays. Please view the sections Delivery for more information.

SHIPPING COST
The shipping costs depend on the delivery address and will appear in the shopping cart before making payment and asking for the payment data. Please check the Delivery terms and Payment section for more information.

CLAIMS
All our products are carefully inspected before delivery. The buyer should also inspect carefully all items at the time of receiving the goods. Claims for damage and shortages must be notified to Monoware Ltd. within two days and written notification received within seven days. We cannot accept responsibility for the non-arrival of notification within the specified time. Failure to make such claims within the specified time constitutes acceptance of the merchandise and its quality.

Monoware Ltd. may not accept claims for damage resulting from storage by the buyer or storage by Monoware Ltd. on behalf of the customer and for damage resulting from accident, alteration or misuse after delivery. Also for dissatisfaction with colour, grain, veneering or texture of wood, marble and leathers because of natural variations over which Monoware Ltd. has no control.  

FAULTY GOODS
We are working hard to ensure your goods arrive in a perfect condition. In the unlikely event of an item or order being found to be wrong, broken, defective, missing a part, lost by the courier, Monoware Ltd. will proceed to the shipment of a free new product as long as the incident has been notified within a maximum of 48 hours after it has been received. Please email webshop@monoware.com, indicating the number of your order, the anomaly detected and supporting photos.

If the order cannot be delivered due to causes outside the control of Monoware Ltd. (as for instance absence of the customer at the given address, after three attempts by the transit agency), the order will return to our facilities. It will be sent again only if the customer accepts to pay again for the shipping cost.

Monoware Ltd. is not responsible for products that are not purchased at monoware.com. The customer must make claims for any incidence directly to the store where the product was bought.

PRICES
The product prices are those published on monoware.com and include 20% VAT. The price must be paid in full at time of purchase. Monoware Ltd. reserves the right to modify at any time the sales prices listed on monoware.com. Items will be charged based on the rates at the time of the order.

In the unlikely event that there is a pricing mistake or the goods are no longer available, we will advise you of this. In this case you will not receive a confirmation email and therefore there will be no contract between us.

TERMS OF PAYMENT
Payment for online orders can be made using credit card, debit card or Paypal. Monoware Ltd. reserves the right to change the terms of payment, create new, or delete any of the existing ones, without the user / customer of monoware.com can make claims for this reason. However, if the change would affect the payment method for an order already made, we will contact the customer to inform him of the change, giving the option to cancel the order.

The payment charge on your card is done in real time through the payment gateway of the financial institution HSBC and Paypal. The charge is only made once the payment system has received the correct information.

In order to provide maximum security during the payment process monoware.com uses secure payment systems by leading financial institutions. You can find additional information on the safety of your data in the Privacy Policy section.

Credit cards are subject to validation checks and authorisation by the card issuer, but if the issuer fails to authorise payment we will not be responsible for any delay or non-delivery. Monoware Ltd. reserves the right to verify the personal data supplied by the customer and take action as appropriate (including the cancellation of the order) to ensure compliance with these conditions.

RESERVATION OF TITLE
Monoware Ltd. remains the owner of the goods until full payment and any interest due are received. When full or partial payment is not made on the due date, Monoware Ltd. can, by registered letter, request the return of goods without losing any rights of suit. Further, Monoware Ltd. has the right to cancel orders by written notification.

DISPUTES
Any disputes will be settled under English law in the courts of London who we deem competent to settle any dispute concerning the sale.

Payment Options

Klarna
In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options: 

1. PAY NOW
This means you can pay by card directly at the checkout. You can always pay using Visa and mastercard, as well as AMEX. Payment is taken when order is confirmed.  

2. PAY LATER
Customer can choose to buy now and pay later. This option will be shown to you at checkout depending on your eligibility and country. If you are not eligible you will still see Pay Now options. You will receive information on how and when to pay when your order has been dispatched.

3. MONTHLY FINANCING 
Customer can choose to open an account with Klarna and receive monthly statements based on the option you chose. This option will be shown at checkout depending on your eligibility and country. If you are not eligible you will still see Pay Now option. You will receive account information when your order is dispatched.

We will take payment from your credit debit card via your Paypal account when your order is dispatched.

Competitions & Promotions

GENERAL
Participation open only to legal residents of the United Kingdom who are at least 18 years of age as of date of entry. Competitions are governed exclusively by the laws of the United Kingdom. Employees, officers and directors of Monoware Ltd., affiliates, partners, advertising and promotion agencies, manufacturers or distributors of Competition materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter.
